These Terms of Use ("Terms") are a legally binding agreement between you and Trail Tails Ltd ("we", "us", "our"). The Service provides a platform featuring a repository of dog walks, a blog, and interactive features for registered users. Registered users can submit their own walk information, including descriptions, location data, and images ("User-Generated Content" or "UGC"). The Service also includes social features, such as the ability for users to create a public profile and connect with other users in a "Pack". We reserve the right to modify or discontinue the Service, or any feature thereof, at any time without notice.
The Service is intended solely for users who are 16 years of age or older. Any access to or use of the Service by anyone under 16 is expressly prohibited. By accessing or using the Service, you represent and warrant that you are 16 or older and have the legal capacity to enter into this agreement. You also warrant that you are legally responsible for any dog(s) you walk using information from the Service.
To access certain features, such as submitting walks or creating a Pack, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate your account if any information provided is inaccurate or if you violate these Terms.
You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service. Prohibited behaviour includes, but is not limited to:
You are solely responsible for the text, images, walk data, reviews, and other content you submit or upload ("User Content").
License Grant: You retain all of your ownership rights in your User Content. However, by submitting User Content to the Site, you grant Trail Tails Ltd a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully paid, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, modify, adapt, publish, and perform the User Content in connection with the Service and our business, including for promoting the Site, in any media formats and through any media channels.
Your Representations and Warranties: You represent and warrant that: (i) you own the User Content posted by you or otherwise have the right to grant the license set forth in these Terms; (ii) the posting and use of your User Content does not violate the privacy rights, publicity rights, copyrights, or any other rights of any person (this includes ensuring you have permission from any identifiable individuals in your photos before uploading them); and (iii) the posting of your User Content will not result in a breach of contract between you and a third party.
Responsibility for Content: You understand that you are solely responsible for your User Content. You agree to provide information that is accurate and truthful to the best of your knowledge. Be aware that images may contain location metadata (EXIF data), and you are responsible for removing this if you do not wish to share this precise location.
Moderation: We do not undertake to review all User Content. However, we reserve the right, but are not obligated, to review, screen, edit, or remove any User Content at our sole discretion and without notice if it violates these Terms or is otherwise deemed inappropriate, inaccurate, or objectionable.
Excluding User Content, all content on the Site, including text, graphics, logos, icons, images, software, and the overall design ("Site Content"), is the property of Trail Tails Ltd or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Site Content without our prior written permission.
If you believe that any content on the Site infringes upon your copyright, please notify us by providing our designated agent with the following information in writing: a description of the copyrighted work that you claim has been infringed; a description of where the material you claim is infringing is located on the Site; your address, telephone number, and email address; a statement by you that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law; and a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner's behalf. Walk Information: All walk information, whether provided by us or by users, is for general guidance only. Trail Tails Ltd does not verify all User-Generated Content for accuracy and does not guarantee the accuracy, completeness, safety, or suitability of any walk. Conditions can change rapidly due to weather, erosion, forestry work, or other factors. Land access rights can change, and routes may include hazards not described, such as difficult terrain, cliffs, fast-flowing water, or busy roads.
Assumption of Risk: Outdoor activities like dog walking carry inherent risks. By using the Service, you voluntarily assume all known and unknown risks associated with these activities. These risks include, but are not limited to, falls, getting lost, adverse weather, encounters with wildlife or livestock, and unpredictable behaviour of your own dog or other dogs.
Your Responsibility: You are solely responsible for your own safety and the safety of your dog(s) and any person with you. You are responsible for making your own risk assessment before and during any walk. Always check local conditions, weather forecasts, and assess your own fitness and the suitability of a walk for your dog. Be aware of local laws, respect private property, and be mindful of livestock. Always carry appropriate equipment, including water, navigation tools, and a first-aid kit for both you and your dog.
User Interactions: You are solely responsible for your interactions with other users of the Service, both online and offline. We are not responsible or liable for the conduct of any user. We encourage you to use caution and good judgment when interacting with others, particularly if you decide to meet in person for a walk.
Site Availability: The Site is provided on an "as is" and "as available" basis. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free.
To the fullest extent permitted by applicable law, in no event shall Trail Tails Ltd (including its directors, employees, partners, agents, suppliers, or affiliates) be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service, including User Content or interactions between users; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content.
Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by English law.
You agree to defend, indemnify, and hold harmless Trail Tails Ltd and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to solicitor's fees), resulting from or arising out of a) your use and access of the Service; b) a breach of these Terms; c) User Content posted by you, including claims that your content is inaccurate or caused harm; or d) your interactions with other users.
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason, including without limitation if you breach the Terms.
If you wish to terminate your account, you may discontinue using the Service or contact us to request account deletion. Upon termination, your right to use the Service will immediately cease. The license you grant us under Section 6 for your User Content will survive termination, meaning we may continue to display content you have submitted. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the competent courts of England and Wales.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect, for example by posting a notice on the Site or sending an email to registered users. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorised representative of Trail Tails Ltd.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Trail Tails Ltd regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
